Terms and Conditions

1. General Terms

1.1. All photography services provided by Andy Hornby Photography are subject to availability and prior booking.

1.2. By making a booking, the client agrees to provide accurate information and abide by the guidelines outlined for their specific session.

1.3. Andy Hornby Photography reserves the right to refuse services if the client fails to provide accurate or appropriate details regarding the session or violates these terms.

2. Bookings and Payment

2.1. A non-refundable booking fee of 25% of the total session cost is required to secure your booking. This fee is due at the time of booking.

2.2. The remaining balance must be paid at least 48 hours before the scheduled session. For commercial and corporate services, alternative payment arrangements may be made by prior agreement.

2.3. Bookings are confirmed upon receipt of the booking fee and a confirmation email from Andy Hornby Photography.

2.4. If the client fails to pay the remaining balance by the due date, Andy Hornby Photography reserves the right to cancel the session without refunding the booking fee.

3. Cancellation Policy

3.1. Cancellations made more than 7 days before the session date will result in the loss of the booking fee but will not incur any additional charges.

3.2. Cancellations made within 7 days of the session date will incur a cancellation fee of 50% of the total session cost, including the non-refundable booking fee.

3.3. Cancellations made within 48 hours of the session will incur the full session fee.

3.4. In the event that Andy Hornby Photography needs to cancel or reschedule the session due to unforeseen circumstances, the client will be offered alternative dates or a full refund, including the booking fee.

4. Session Rights and Deliverables

4.1. Andy Hornby Photography retains the copyright to all images and videos taken during the session, unless otherwise agreed in writing.

4.2. Clients will receive high-resolution images or videos based on the package chosen. Additional edits or alterations to the final deliverables may incur extra charges.

4.3. The client is granted a license to use the images or videos for personal, non-commercial purposes, such as sharing on social media or printing for personal use.

4.4. Commercial use of the images or videos requires prior written consent from Andy Hornby Photography and may involve additional fees.

5. Usage Rights for Commercial Photography

5.1. For corporate headshots, commercial photography, or any business-related session, clients may use the images or videos for professional purposes, such as websites, advertisements, or marketing materials.

5.2. Andy Hornby Photography retains the right to use any images or videos for promotional purposes, including the portfolio, website, or social media platforms, unless otherwise agreed upon in writing.

6. Rescheduling

6.1. Clients may request to reschedule their session without penalty if made at least 48 hours before the session date. Rescheduling requests made within 48 hours may incur a rescheduling fee, depending on the service booked.

6.2. Any rescheduled session must take place within 3 months of the original booking date, subject to availability.

7. Liability

7.1. While every effort is made to deliver high-quality photography services, Andy Hornby Photography shall not be held liable for unforeseen circumstances that affect the quality of the images (such as poor weather conditions, lighting restrictions, or venue limitations).

7.2. In the event of equipment failure or other unforeseen issues on the part of Andy Hornby Photography, liability will be limited to the amount paid for the service, and a reshoot may be offered at no extra charge.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or related to these terms shall be resolved in the courts of England and Wales.
